By using NimbusGo services, you agree to the following terms of service. Please read these terms carefully. These terms of service govern all conditions related to the use of the NimbusGo website and platform. You must accept these terms before using our services.
Service Description
NimbusGo is a cloud-based operations platform for restaurants, cafes, and courier companies. The platform brings POS, courier management, billing, digital signage, and content studio workflows into one panel. Our services are provided on a subscription basis and priced according to the modules selected by users.
Acceptance of Terms
By using the NimbusGo platform or registering for our services, you agree to these terms of service and our privacy policy. If you do not agree to these terms, please do not use the platform and do not benefit from our services.
Account Responsibility and Security
You are solely responsible for the security of your account: • You must keep your password secure and not share it with anyone • You must immediately notify us if you suspect unauthorized access • You are responsible for all transactions made under your account • Two-factor authentication (2FA) is recommended • You must log in regularly to keep your account active In case of account security breaches, your account may be temporarily or permanently suspended.
Usage Rules and Obligations
When using the platform, you must comply with the following rules: • You must use the platform only for legal and legitimate purposes • You must not violate others' rights (copyright, trademark, personality rights) • You must not share harmful, threatening, offensive, or illegal content • You must not engage in spam, phishing, or fraud activities • You must not engage in activities that threaten system security • You must not gain unauthorized access to others' accounts • You must not perform operations that would damage the platform's technical infrastructure Failure to comply with these rules may result in immediate suspension or termination of your account.
Intellectual Property Rights
The NimbusGo platform, its software, design, content, and all materials are the intellectual property of Arpeta Yazılım and are protected by copyright, trademark, and other intellectual property laws. • You may not copy, reproduce, or distribute platform content without permission • You may not use the NimbusGo brand or logos without permission • You may not attempt to reverse engineer the platform's source code • You may not resell or license the platform for commercial purposes The intellectual property of content you create on the platform (data, documents, etc.) belongs to you, but you are deemed to have granted us the necessary licenses for storage and processing on the platform.
Payment and Billing
NimbusGo services are billed on a subscription basis: • Pricing is determined based on selected modules and number of users • Payments are automatically collected at specified payment periods (monthly/annual) • Invoices are sent to your registered email address • Service may be suspended if payment is not made • Cancellations take effect at the end of the current billing period • Refund policy is subject to the conditions specified in the service agreement
Liability Limitation
NimbusGo cannot be held liable in the following cases: • Indirect, special, incidental, or consequential damages arising from platform usage • Data loss or data corruption (backup is user's responsibility) • Issues arising from third-party services • Damages caused by user error or negligence • Interruptions due to internet connection or infrastructure issues • Force majeure situations such as natural disasters, war, terrorism NimbusGo's total liability is limited to the total fee paid by the user in the last 12 months.
Account Termination
Your account may be terminated in the following cases: • Violation of terms of service • Non-payment (after 30 days of delay) • Engaging in illegal activities • Threatening platform security • Cancellation at your own request Upon account termination: • Your access is immediately cut off • Your data may be retained for legal retention periods • 30 days are granted for backup and data transfer • Unpaid invoices are collected
Changes and Updates
We reserve the right to change these terms of service, our services, or our pricing at any time: • Changes are announced through the platform or via email • Important changes are notified at least 30 days in advance • If you do not accept the changes, you may cancel the service • Your continued use of the service is deemed acceptance of the changes • Current terms are effective from the date of publication on the website
Dispute Resolution
Disputes arising from these terms of service: • Are first attempted to be resolved through friendly negotiations • If not resolved, the laws of the Republic of Turkey apply • İskenderun/HATAY courts are authorized • Alternative dispute resolution methods (arbitration, mediation) may be used Consumer rights are reserved. As a consumer, you may apply to consumer arbitration committees.
